Overview
This website is operated by 12460921 Canada Inc. (doing business as Art of the Problem). Throughout the site, the terms "we", "us" and "our" refer to 12460921 Canada Inc. and Art of the Problem. By visiting our site or purchasing something from us, you engage in our "Service" and agree to be bound by the following terms and conditions.
Section 1 - What we sell
We sell both digital and physical products.
- The GrowBot Pass, a digital product that gives you access to the GrowBot application, an identity for your creature, an allowance of brain credits, and the full guided build instructions and files.
- Brain credits, prepaid top-ups that let your creature keep thinking.
- The Growbot Founder Batch Kit, physical hardware sold as a preorder and shipped when manufactured.
- Apparel, physical goods printed to order and shipped by our print partner.
- Music, delivered as digital audio files.
Digital products are delivered by email and are not shipped. Physical products are shipped as described in our shipping and delivery policy.
Section 2 - The GrowBot Pass and brain credits
The GrowBot Pass grants you a personal, non-transferable licence to use the GrowBot application and the build materials that come with it. You are buying access to software, not ownership of it.
Brain credits are a prepaid allowance for the computing that makes your creature think. Running that computing costs us real money, and credits are how you cover your share of it. Brain credits are not a currency and not an investment. They have no cash value, cannot be transferred to another person, cannot be exchanged for cash, and are consumed as your creature is used.
The application is offered as it is and it is still being actively developed. Features may change, improve, or be removed, and the creature's behaviour is generated and will not be identical for any two people. We do not guarantee any particular outcome, personality, or capability.
You may not resell, sublicense, or share your pass or your access link, and you may not attempt to circumvent the credit system.
Section 3 - Music licence
When you purchase music from Art of the Problem, you are purchasing a licence for personal use only, not the copyright to the music.
You may: download the files to your personal devices, listen for personal enjoyment, and transfer them to your own devices for your own use.
You may not: resell, share, or redistribute the files, upload them to file-sharing sites, use them in commercial projects such as videos, films, advertising or podcasts without a separate commercial licence from us, or claim the music or composition as your own work.
Art of the Problem retains all ownership, copyright, and intellectual property rights in the music sold on this site.
Section 4 - Hardware, preorders, and safety
The Founder Batch Kit is early hardware from a first production run, sold to people who want to build something with us rather than buy a finished consumer product. Estimated dispatch dates are estimates. Materials and finish may change between now and manufacture, and we describe the current state honestly on the product page.
The kit contains small parts and a battery and is intended to be assembled by adults, or by children with adult supervision. Assemble and power it as described in the build guide.
Section 5 - Accuracy of billing and account information
We reserve the right to refuse any order. If we change or cancel an order we will attempt to notify you using the email or billing address provided at the time of purchase. You agree to provide current, complete and accurate purchase information so we can complete your transaction and contact you if needed.
Section 6 - Limitation of liability
We do not guarantee that your use of our service will be uninterrupted, timely, secure, or error free. In no case shall 12460921 Canada Inc. (doing business as Art of the Problem), our directors, officers, employees, affiliates, agents, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind arising from your use of the service or of any product purchased through it.
Section 7 - Third party tools
We may provide access to third party tools and services, including payment processing, digital delivery, print fulfilment, and the model providers that power the application. We neither monitor nor control these, and we provide access to them as they are, without warranties or conditions of any kind.
Section 8 - Governing law
These Terms of Service are governed by and construed in accordance with the laws of Ontario, Canada.

You can review the most current version of these Terms of Service at any time on this page. We reserve the right to update, change, or replace any part of them by posting the update here.
